2.1.These terms and conditions apply to every offer and all distance agreements between the customer and The Jane, via the website, related websites, or by phone.
2.2.General purchase terms of the customer do not apply.
2.3.The customer can consult these terms via a link on the website or reservation modules. They are available as a PDF and can be saved or printed. During the ordering process, the customer must confirm having read and accepted these terms.
2.4.For phone orders, the customer receives these terms as a link in the confirmation email.
3.1.The purchase process begins when the customer confirms a reservation and/or adds products to the shopping cart. The agreement is concluded when the customer accepts these terms and definitively confirms the order or reservation.
3.2.The offered products and services are clearly and sufficiently detailed on the website and webshop so the customer can make a correct assessment. If there is doubt about the content, the customer must obtain information from The Jane in advance.
3.3.The prices on http://www.thejaneantwerp.com are stated with great care. Any errors do not bind The Jane as long as the distance sale is not completed. After completion, the prices as shown in the order overview apply. Offers are valid while stocks last.
3.4.The listed price is not always a total price. Beverages or options can be additionally ordered on-site and are charged separately. Unless explicitly stated, food and drink are never included. Options that are included are clearly and exhaustively stated.
4.1.If the customer is a natural person purchasing for private use, they have the right to withdraw from the purchase within fourteen calendar days after delivery of the product or after concluding the service agreement, without reason and without costs. Only the direct costs of returning goods are borne by the customer.
4.2.The right of withdrawal does not apply in the following cases:

5.1.Payment via Stripe
All payments for reservations and purchases are handled electronically via Stripe, a secure and recognized payment provider. By completing the payment, the customer agrees that Stripe processes the payment according to its terms.
The customer is responsible for correctly entering payment details. These details are not stored by us and are only used for the payment. After successful payment, the customer receives a confirmation, depending on the payment method, which finalizes the agreement.
5.2.Refund
If a refund is required, the amount will be returned within 5 to 10 business days via the same payment method as the original payment. The amount corresponds to the paid amount.
5.3.By using the payment function via Stripe, the customer agrees to these terms and the processing of the payment.
6.1When concluding the distance agreement, a deposit (partial or full) may be requested, or credit card details provided as a guarantee. Specific cancellation rules apply.
6.2If a deposit is requested, the customer receives a final payment date. This date depends on the time of the order.
6.3If the deposit is not received on time, The Jane may unilaterally terminate the agreement without further notice.
6.4If an online payment transaction is not completed within 30 minutes after confirmation, The Jane may also unilaterally cancel the agreement.
6.5If the customer enters invalid or non-owned credit card details, The Jane reserves the right to cancel the agreement.
6.6For phone sales, paying the deposit or providing credit card details constitutes irrevocable acceptance of these terms.
6.7Customer cancellation after deposit payment or purchase of goods
6.8Application of cancellation rules
The cancellation rules are always strictly applied. The customer may not invoke force majeure (such as accident, bad weather, illness, death, impediment, etc.).
6.9Cancellations can only be made via the reservation system, confirmation email links, email, or phone. A cancellation is only valid when confirmed in writing (by email) by The Jane.
6.10No-show and late absence
Failure to attend or arriving late (no-show) is considered a late cancellation. In such case, The Jane has the irrevocable right to apply the cancellation rules and collect the corresponding fees.
7.1.When placing an order or reservation, the customer always receives a confirmation email, provided a valid email address is given.
7.2.For collecting goods or executing services, the customer receives a reminder by email.
7.3.The customer cannot opt out of receiving payment reminders if the deposit is not immediately paid online.
7.4.It is technically never guaranteed that all confirmations and reminders will always be sent by email. Failure to receive them cannot lead to termination of the agreement.
7.5.If the customer has not received a confirmation or reminder, they can contact The Jane to have it resent.
8.1.This agreement is exclusively governed by Belgian law.
8.2.Disputes arising from this agreement are exclusively handled by the competent courts in Antwerp.
8.3.The customer making the reservation or order is held liable by The Jane for any damages arising from the use of services or compliance with the terms.
8.4.If you have a complaint about our services, products, or their handling, you may contact us within 14 days via contact@thejaneantwerp.com. Please include your reservation or order number and a brief description of your complaint.
9.1.At The Jane NV, we attach great importance to protecting your privacy and confidentiality. Your personal data is used exclusively to process your reservations, orders, payments, and to inform you about our services. During your visit, your data may be used internally for reservation execution, service, and security purposes.
9.2.We process your data in accordance with applicable legislation, including the GDPR. Your data is not shared with third parties without your consent, unless required for service provision or legally obligated.

10.1.These terms apply to all digital gift vouchers issued by The Jane NV. By using a voucher, the consumer agrees to these terms.
10.2.Digital vouchers are sold via our website www.thejaneantwerp.com and can be used as payment at Restaurant The Jane, Limastraat 5, 2000 Antwerp, unless otherwise stated.
10.3.Digital vouchers are valid for 2 years from the date of issue. After this period, the voucher cannot be used, and the value expires.
10.4.An administrative fee is applied when purchasing a digital voucher. This fee is automatically included in the purchase amount.
10.5.The digital voucher can be used at the restaurant to pay for food, drinks, and merchandise up to the full value. Amounts exceeding the voucher value must be paid by the consumer.
The voucher cannot be redeemed for cash or other refunds. Remaining balances are not paid out or returned.
10.6.The digital voucher is sent by email to the customer’s provided email address. The customer is responsible for providing the correct email address.
10.7.Loss, theft, or damage of the digital voucher does not entitle replacement or refund unless the voucher is still valid and proof of purchase is provided.
10.8.Multiple digital vouchers can be used for a single invoice unless otherwise indicated. Use of the voucher(s) must be indicated at the time of payment.
10.9.Additional conditions may apply during special offers or promotions.
10.10.The Jane NV reserves the right to modify these terms or no longer accept digital vouchers without prior notice.
10.11.Belgian law applies to these terms. Any disputes arising from these terms or the use of the voucher are resolved by the competent courts in Antwerp.
