2. Scope and Framework of the Agreement

2.1.These terms and conditions apply to every offer and all distance agreements between the customer and The Jane, via the website, related websites, or by phone.

2.2.General purchase terms of the customer do not apply.

2.3.The customer can consult these terms via a link on the website or reservation modules. They are available as a PDF and can be saved or printed. During the ordering process, the customer must confirm having read and accepted these terms.

2.4.For phone orders, the customer receives these terms as a link in the confirmation email.

3. Prices and Formation of the Agreement

3.1.The purchase process begins when the customer confirms a reservation and/or adds products to the shopping cart. The agreement is concluded when the customer accepts these terms and definitively confirms the order or reservation.

3.2.The offered products and services are clearly and sufficiently detailed on the website. If there is doubt about the content, the customer must obtain information from The Jane in advance.

3.3.The prices on http://www.thejaneantwerp.com are stated with great care. After completion, the prices as shown in the order overview apply.

3.4.The listed price is not always a total price. Unless explicitly stated, food and drink are never included. Options that are included are clearly stated.

4. Reflection Period and Right of Withdrawal

4.1.If the customer is a natural person purchasing for private use, they have the right to withdraw from the purchase within fourteen calendar days after delivery or after concluding the agreement, without reason. Costs for returning goods are borne by the customer.

4.2.The right of withdrawal does not apply to services already started, personalized products, perishable goods, or gift vouchers.

4.3.The right of withdrawal does not apply to traders or professional use.

5. Payment

5.1.Payments are handled via Stripe. The customer is responsible for correctly entering payment details; these are not stored by us.

5.2.Refunds will be processed within 5 to 10 business days via the original payment method.

6. Deposit and Cancellation Rules

6.1When concluding the agreement, a deposit or credit card guarantee may be requested. Specific cancellation rules apply.

6.7Cancellations made less than 48 hours before delivery (arrival time) will incur an administration fee of €150 per person. This also applies to no-shows or arriving with fewer people than reserved without timely notice.

6.8Cancellation rules are always strictly applied, regardless of force majeure.

7. Confirmations and Reminders

7.1.The customer always receives a confirmation email, provided a valid email address is given.

8. Applicable Law, Liability, and Complaints

8.1.This agreement is exclusively governed by Belgian law. Disputes are handled by the competent courts in Antwerp.

8.4.Complaints must be submitted within 14 days via contact@thejaneantwerp.com.

9. Privacy and Data Management

9.1.Your personal data is processed in accordance with the GDPR for processing reservations, payments, and providing information.

9.2.For the execution of the agreement, we use external processors. For incoming telephone calls, we use Hello Pollie B.V. (“Bonnie”), who provides an AI telephone assistant and processes/records calls on our behalf.

9.3.You have the right to access, correct, or delete your data. For more information regarding retention periods and your rights, please refer to our full Privacy Policy on our website.

10. Digital Gift Vouchers

10.3.Digital vouchers are valid for 2 years from the date of issue.

10.5.Vouchers are not redeemable for cash; remaining balances are not paid out or returned.
